Regulations of the ScanSpectrum website

§ 1. General provisions

  1. These Regulations define the rules for using the website scanspectrum.ai, hereinafter referred to as the "Website", and the rules for providing electronic services via it.
  2. The owner of the Website and the service provider is:

  3. The Regulations are made available free of charge on the Website in a way that allows them to be displayed, saved and reproduced.
  4. Use of the Website is voluntary.
  5. Services provided electronically via the Website are free of charge.
  6. The User of the Website, hereinafter referred to as the "User", may be a natural person, a legal person or an organizational unit using the Website.

§ 2. Nature and purpose of the Website

  1. The website is informative, product and contact in nature.
  2. The website is used in particular for:
    • a) presenting information about the ScanSpectrum device,
    • b) presenting the technology, functionality and possible applications of ScanSpectrum,
    • c) presenting information about the activities of QED Poland,
    • d) providing information materials regarding ongoing research, implementations and applications of technologies,
    • e) enabling contact with QED Poland,
    • f) enable sending inquiries regarding the device, cooperation, research, implementation or other services of QED Poland.
  3. The website does not currently allow concluding sales contracts for the ScanSpectrum device or making online payments.
  4. Information regarding products, services, possible applications, technical parameters or terms of cooperation posted on the Website is for informational purposes, unless expressly indicated otherwise.
  5. Sending an inquiry via the contact form does not constitute the conclusion of a sales contract, research contract, development of an analytical model, implementation or any other paid contract.
  6. Detailed terms of possible cooperation are agreed individually between QED Poland and the interested entity.

§ 3. Services provided electronically

  1. Through the Website, the Service Provider provides the following services electronically:
    • and) sharing the content of the Website – enabling the User to view information, materials, graphics, product content and other materials posted on the Website,
    • b) contact form – enabling the User to send a message to QED Poland,
    • c) electronic contact – enabling the User to contact the Service Provider using the contact details provided on the Website.
  2. Using the Website does not require creating a user account.
  3. The website does not currently provide a newsletter service.
  4. Links to external social networking sites are only used to enable the User to go to the appropriate QED Poland or ScanSpectrum profiles. When you switch to an external website, the rules set by its operator apply.

§ 4. Contact form

  1. The User can contact QED Poland using the contact form available on the Website.
  2. The following information may be collected in the form:
    • a) name and surname,
    • b) telephone number,
    • c) e-mail address,
    • d) country,
    • e) name of the institution or organization with which the User is associated.
  3. Providing data is voluntary, however, providing data marked as required may be necessary to submit the form and receive a response.
  4. The User is obliged to provide true, current data relating to himself or herself or data that he or she is authorized to provide.
  5. Sending the form transfers its content to QED Poland for the purpose of handling the inquiry.
  6. Submitting the form does not oblige either party to conclude a contract.
  7. If the User separately consents to marketing contact, QED Poland may use the communication channels indicated by the User to the extent covered by this consent.
  8. Expressing marketing consent is not a condition for sending an inquiry or obtaining a response to the contact form.
  9. Detailed information regarding the processing of personal data is provided Privacy and cookies policy available on the Website.

§ 5. Technical conditions

  1. To use the Website you need:
    • a) a device with Internet access,
    • b) current web browser,
    • c) enabled support for standard Internet technologies necessary for the proper display of the Website,
    • d) when using the form - the ability to provide a valid e-mail address or other required contact details.
  2. Some elements of the Website may require JavaScript support.
  3. The website uses technologies necessary for its proper operation and may use, after obtaining the required consent, analytical tools.
  4. The website uses Google Analytics only in accordance with the principles set out in the Privacy and Cookies Policy and the User's consent settings.
  5. The User may use the basic functionalities of the Website without consenting to analytical cookies.

§ 6. Rules of using the Website

  1. The User is obliged to use the Website:
    • a) in accordance with applicable law,
    • b) in accordance with these Regulations,
    • c) in a way that does not violate the rights of the Service Provider or third parties,
    • d) in a way that does not interfere with the proper functioning of the Website.
  2. It is prohibited to provide illegal content via the Website.
  3. In particular, it is prohibited:
    • a) sending content that violates the law, personal rights, intellectual property rights or other rights of third parties,
    • b) using the form to send spam,
    • c) introducing malicious software or code to the Website that may disrupt its functioning,
    • d) attempting to gain unauthorized access to the Website, its infrastructure or data,
    • e) taking actions that may lead to overload or disruption of the operation of the Website,
    • f) impersonating another person or entity,
    • g) using the Website to conduct illegal activities.
  4. If actions are found that violate the Regulations or applicable regulations, the Service Provider may take appropriate technical or legal actions to protect the Website and its rights.

§ 7. Conclusion and termination of the contract for the provision of electronic services

  1. The agreement regarding the service of sharing the content of the Website is concluded when you start using the Website.
  2. This agreement is concluded for the period of use of a given service.
  3. The User may terminate the use of the service at any time by leaving the Website.
  4. In the case of a contact form, the contract for the provision of electronic services is concluded when you start using the form and ends after its submission or earlier discontinuation of using the form.
  5. Using the Website does not require concluding a fixed-term contract or creating an account.
  6. The User shall not pay any fee to QED Poland for terminating the use of electronic services specified in these Regulations.

§ 8. Special risks related to the use of electronic services

  1. The use of the Internet and services provided electronically may involve risks typical of the use of ICT networks.
  2. The potential threats include in particular:
    • a) malware operation,
    • b) attempts to obtain information or credentials,
    • c) unauthorized access to the User's device or data,
    • d) transmission interception when using unsecured devices or networks,
    • e) impersonating other people or entities,
    • f) exploiting security holes in the User's software or devices.
  3. In order to reduce the risk, it is recommended in particular:
    • a) using a current operating system and browser,
    • b) using up-to-date security software,
    • c) be careful when opening links and messages from unknown sources,
    • d) use of trusted networks and devices.
  4. The Service Provider uses technical and organizational measures to ensure an appropriate level of security of the Website.

§ 9. Content and information regarding ScanSpectrum

  1. The Service Provider exercises due diligence to ensure that the information published on the Website is up-to-date and reliable.
  2. The parameters, applications and results presented in relation to ScanSpectrum may depend in particular on:
    • a) type of material tested,
    • b) the measurement method used,
    • c) conditions of measurement,
    • d) method of sample preparation,
    • e) the analytical or calibration model used.
  3. Information about the ability to determine a specific parameter does not mean that a given model or functionality is automatically available for every type of sample or every application if its use requires a separate calibration, model or procedure.
  4. The information posted on the Website is for informational purposes and does not constitute individual agronomic, laboratory, medical, nutritional or other specialist advice.
  5. In the case of research and development projects, development of analytical models or other individual implementations, the scope, methodology, evaluation criteria and liability of the parties are specified in a separate agreement.

§ 10. Intellectual property rights

  1. The content on the Website may be subject to protection under copyright law, industrial property law or other intellectual property regulations.
  2. In particular, the following may be protected:
    • a) texts,
    • b) photographs,
    • c) graphics,
    • d) charts,
    • e) video materials,
    • f) logos and markings,
    • g) elements of visual identification,
    • h) documentation and materials regarding ScanSpectrum,
    • i) software elements of the Website.
  3. Using the Website does not transfer any intellectual property rights to the User.
  4. The User may use the content of the Website to the extent permitted by applicable law.
  5. The use of materials beyond permitted use may require the prior consent of the authorized entity.

§ 11. Availability and functioning of the Website

  1. The Service Provider takes steps to ensure the proper operation of the Website.
  2. The website operates using IT infrastructure, including services Cloudflare Workers.
  3. Access to the Website may be temporarily limited, in particular due to:
    • a) technical or maintenance work,
    • b) updates,
    • c) failure,
    • d) the need to remove the security threat,
    • e) problems occurring on the part of ICT infrastructure providers,
    • f) other events beyond the reasonable control of the Service Provider.
  4. The Service Provider may make changes to the structure, appearance, functions or content of the Website.
  5. The provisions of this paragraph do not exclude or limit the Service Provider's liability to the extent that such exclusion or limitation would be unacceptable under applicable law.

§ 12. External websites and content

  1. The website may contain links to websites and services operated by third parties, in particular to QED Poland or ScanSpectrum profiles on social media.
  2. Clicking on such a link takes you to an external website.
  3. The use of an external website is subject to the terms and conditions specified by its operator.
  4. QED Poland has no influence on the principles of operation, content or privacy policy of independent external websites.

§ 13. Personal data and cookies

  1. The rules for processing Users' personal data are specified ScanSpectrum privacy and cookies policy.
  2. The administrator of personal data is:

  3. Contact in matters relating to personal data is possible at: scanspectrum@qed.ai
  4. The website uses cookies and similar technologies on the terms set out in the Privacy and Cookies Policy.
  5. Analytical technologies requiring the User's consent are used only after obtaining it.

§ 14. Complaints

  1. The User may submit a complaint regarding the operation of the Website or services provided electronically.
  2. The complaint should be sent to the following address: scanspectrum@qed.ai
  3. In the complaint, it is recommended to provide information enabling its consideration, in particular:
    • a) User's contact details,
    • b) description of the problem,
    • c) indication of the functionality to which the complaint relates,
    • d) date of occurrence of the problem, if known.
  4. Providing the information indicated in section 3 is not required to the extent that they are not necessary to consider a given complaint.
  5. The Service Provider will consider the complaint without undue delay, no later than the deadline 14 days from the date of receipt.
  6. The response will be sent to the e-mail address or via another agreed communication channel.

§ 15. Changes to the Regulations

  1. The Regulations may be amended in particular in the event of:
    • a) changes in applicable legal provisions,
    • b) changes to the Service Provider's data,
    • c) changes in the functionality of the Website,
    • d) introduction of new services,
    • e) changes in technical solutions,
    • f) the need to improve the security or operation of the Website.
  2. The current version of the Regulations is published on the Website along with the date of the last update.
  3. Changes to the Regulations do not violate the rights acquired by Users before the changes enter into force.

§ 16. Final provisions

  1. In matters not regulated in the Regulations, the relevant provisions of Polish law shall apply.
  2. The provisions of the Regulations do not exclude or limit the rights of consumers and other persons under mandatory provisions of law.
